Accused Manhattan Heights rapist enters third not guilty plea

During an arraignment Monday, Accused Manhattan Heights Rapist, Arturo Valtierra-Payan, 25, pleaded not guilty to burglary of habitation and aggravated sexual assault.

Valtierra has been in jail since his arrest in July, and was wearing an orange and white striped jumpsuit in the courtroom. He showed little emotion and only hung his head on several occasions.

Valtierra was first arrested in July for burglary of habitation. Then on August 29, he was re-booked on six additional charges including three counts of burglary of habitation and three counts of aggravated sexual assault for attacks. The cases involve four different victims.

His attorney, public defender Robert Riley, filed a motion to disqualify the prosecutors, Betty Arvin and Sheila Wynn, who are from the Tarrant County District Attorney's Office. Tarrant County includes Arlington and Fort Worth.

As NewsChannel 9 previously reported, El Paso Police linked Valtierra to a sexual assault case that happened in the Fort Worth area in September, 2012.

Arvin and Wynn said Monday he could be connected to two cases in the Fort Worth area.

Judge Luis Aguilar said he will schedule a hearing in approximately two weeks to determine if the Fort Worth prosecutors will remain on the case.
