El Pasoan pleads not guilty to toddler death, defense blames boyfriend

A 23-year-old El Paso woman is on trial for capital murder and pleads not guilty.

Lorraine Merjill is accused of abusing her 20-month-old daughter, Desiree, to the point of death.

Merjill is being charged with 3 counts including capital murder, murder, and injury to a child.

Desiree Merjill died on July 30, 2011 from internal bleeding in East El Paso. Her mother is accused of hitting her with her hand, elbow, and knee to the toddler's stomach because she was being fussy before bedtime.

During the first day of the trial on Tuesday, a juror was thrown out by the judge for discussing the case during jury selection.

Defense claims the boyfriend is the one who committed the crime.
