Las Cruces man attacks girlfriend's estranged husband with bat

Las Cruces Police arrested  Javier J. Hernandez, 35, of the 300 block of north Mesquite Street on Monday morning after police say he beat his girlfriend's husband with a baseball bat early Monday morning.

Police were dispatched to the 200 block of Avenida de Mesilla at approximately 2:30 a.m. Monday morning and found a man who had multiple non-life-threatening injuries to his legs, arms and upper torso.

Detectives say that the victim was walking along Avenida de Mesilla when his estranged wife drove by and began arguing with him. The woman stopped her vehicle and Hernandez, her boyfriend, exited and began to beat the victim with a baseball bat. Hernandez also allegedly threatened the victim with a pocket knife.

Hernandez and the woman fled the scene and drove to a nearby apartment where police located them a short time later and detained Hernandez for questioning. Inside the apartment police located the knife in a medicine cabinet, and the baseball bat and Hernandez' bloody shirt in a closet.

Hernandez has been charged with a third-degree felony battery  and a fourth-degree felony assault and tampering charge. Hernandez was booked into the Dona Ana County Detention Center with bond set at $10,000.
