Questions arise in same-sex health benefits suit

El Paso County is only one in a handful of local government agencies which offer benefits to same-sex couples.

A lawsuit, filed by Carl Starr, an El Pasoan, claims the county's current health benefits is unconstitutional. As we've reported, the Attorney General of Texas claims any city or state offering benefits to same sex couples is unconstitutional because marriage should only be allowed between a man and a woman.

"What if a couple is married, a same sex couple is married in another state, moves to El Paso what is the language that should... Should we recognize that in our policy and I'm pretty certain, if I were a gambling person, I'm pretty certain that the county attorney's office will say - just do the plus one, it's cleaner, simpler, easier,” Judge Veronica Escobar explained.

The Judge said they are still working out this question as well as others and will revisit the issue in the coming weeks.
