LAS CRUCES, N.M. — The fate of a proposed Las Cruces strip club will be in the hands of city councilors when they hear an appeal for approval of a special use permit Monday afternoon.
Central Park West LLC filed an appeal after the city's Planning and Zoning Commission voted against granting the special use permit in a September meeting.
The proposed "Bronx Club" would be located on Westgate Court near Amador Avenue in an industrial part of town.
The city requires adult establishments be at least 1000 feet away from any schools, churches, daycares, parks and residential areas and also 500 feet away from any businesses that sell alcohol.
The location met those requirements with an already established adult bookstore next door.
During the September meeting, the commission heard from dozens of citizens opposing the club.
The commission decided allowing the permit would negatively impact surrounding businesses and the city as a whole.
Karen Wooten, the attorney representing Central Park West, said in the appeal the decision was not based solely on zoning requirements.
"The public input in opposition to the SUP (Special Use Permit) was based on opposition to adult entertainment, not on any evidence that the application failed to satisfy applicable City Code requirements," Wooten wrote in the appeal.
Wooten also said in the appeal there was no evidence presented to the commission contradicting the recommendations staff had made.
If approved by council, the club would have to meet certain conditions including building a non-see through wall or fence around the property and no parking signs on Westgate Court to help surrounding business deal with added traffic in the area.
