Colorado prosecutors will seek the death penalty for accused movie theater gunman James Holmes.
The Arapahoe County District attorney declared his intention during a court hearing today.
The 25 year-old, Holmes, accused in the July 2012 slaying of 12 people, showed no emotion when he heard the news.
Holmes is charged with multiple counts of murder and attempted murder in the shooting spree, which also wounded dozens of moviegoers in Aurora, Colorado.
Defense Attorneys said Holmes would plea guilty in exchange for life in prison without the possibility of parole, but prosecutors rejected the plea deal.
Attorneys now say they will consider a mental illness defense.
Holmes is scheduled to go on trial in February of next year
